Stalking, Threats, Violation of Restraining Order: 28-Year-Old Man Sentenced to 1 Year in Prison

Batumi City Court found a 28-year-old man guilty of stalking his ex-wife, along with other crimes, and sentenced him to 1 year in prison.
During the investigation, it was established that the man had been meeting his ex-wife at her home and workplace for several weeks without her knowledge, maintaining constant contact via phone and social networks, and disturbing her family members and friends.

Ekaterine Muzashvili, a lawyer from the Adjara region of “Sapari,” has been representing the interests of the victimized woman since June 2022. At the time “Sapari” became involved in the case, the man was under investigation for three episodes of threats and violation of a restraining order, but he had not been arrested and continued to disturb the woman. Once “Sapari” was involved, an additional episode of threats was added to the investigation, which was then expanded to include charges of stalking. As a result, the man was arrested.

During the investigation, the woman underwent a psychological examination at the National Bureau of Forensic Expertise named after Levan Samkharauli. She described incidents during the harassment that forced her to change her lifestyle, such as refraining from going for walks or socializing with friends. There was an instance where she had to call the police to get home from work because her ex-husband was waiting outside. Despite her unanswered calls, the man continued to contact her. Despite these details, the bureau concluded that the woman did not experience psychological suffering. It is worth noting that, in similar cases, expert confirmation of psychological suffering is a key factor in issuing a guilty verdict. Nevertheless, Batumi City Court found the man guilty of Stalking and, as previously mentioned, sentenced him to 1 year in prison.
